The Lessor and the Tenant have a Fixed Term Tenancy Agreement (“Tenancy”). The Tenant has asked the Lessor
to allow early termination of the Tenancy. In consideration of the Lessors agreement to the early termination the
Lessor and the Tenant agree that;
1. The Tenant will pay rent and other charges in accordance with the Tenancy (including those provided for
Residential Tenancies Act
by the
), until a new tenancy agreement for the Premises starts or until
expiration of the Tenancy, whichever is sooner;
2. The tenant is aware that there must be 7 days vacancy prior to a new tenant moving in for the purpose of
carrying out a vacate inspection, and that the tenant is responsible for payment of rent for those 7 days.
3. The Tenant authorises the Lessors Agent to supply any prospective tenant with particulars relevant to a
proposed tenancy of the Premises.
4. The Tenants will pay for advertising costs of $120 (once only fee) for .au, .au &
.au. Advertising will not commence until payment is received in full.
5. The Tenants will pay (to the Agent) a break lease fee equal to one weeks rent + GST. This amount is
payable upon securing a new tenant for the property. This fee cannot be deducted from your bond under
any circumstances.
6. The tenant is responsible for payment of ALL pool chemicals until a new tenant is found. The
tenant is also responsible for ensuring the property is clean the day that the new tenant
moves in. This means a spruce clean may be required and if the tenant has left Cairns, a
professional will be hired to do so at the tenant’s expense.
7. The existing Tenancy will terminate when a new Residential Tenancy Agreement has been entered into
with the replacement tenant.
8. The Agent is acting for the Lessor in all matters arising under this agreement.
