NOTICE CONCERNING YOUR RIGHTS TO FILE A COMPLAINT WITH CIVIL RIGHTS ENFORCEMENT
AGENCIES.
Any employee or applicant for employment who believes that he or she has experienced discrimination has a right to file a
formal complaint with the federal, state or local agencies listed below. A person does not give up this right when he or
she files a complaint with the Fire Department EEO Officer, or any of the EEO Counselors. The following federal,
state and local agencies enforce laws against discrimination:

STATUTORY TIME PERIODS FOR THE TIMELY FILING OF AN EEO VIOLATION OR CHARGES OF
DISCRIMINATION (MEASURE FROM THE OCCURRENCE OF A DISCRIMINATORY ACTION):
1. Fire Department’s EEO Office – ONE YEAR (this policy).
2. New York City Commission on Human Rights-ONE YEAR-(NYC Administrative Code, Title 8, Chapter 1).
3. New York State Division of Human Rights-ONE YEAR-(New York Executive Law, Article 15, Section 297(5);
see also Section 297(9) (May file civil action first, but administrative action is then precluded).
4. United States Equal Employment Opportunity Commission-180 DAYS-Unless a proceeding involving same
acts is instituted first before the New York State Division of Human Rights or New York City Commission on
Human Rights. Where a proceeding is first initiated before the State Division of Human Rights or the City
Commission on Human Rights (#1 and #2 above), filing before EEOC must occur within 300 DAYS (However,
it is advisable to file before expiration of 240 DAYS because of a requirement that a complaint must be
deferred to local or state anti-discrimination agency for 60 DAYS) or within 30 DAYS after receiving notice
that the State Division or the City Commission has terminated the proceedings under state or local law,
whichever is earlier (42 U.S.C. Section 2000e-5e).
5. Office of Federal Contract Compliance Programs-Within 180 DAYS-(41 CFR Section 60-1.21 (1990)).
I affirm that I have read the above notice concerning my rights to file a complaint with federal, state, and local civil rights
enforcement agencies at anytime before or after I file an internal complaint with the Fire Department’s EEO Office, and I
am aware of my filing deadlines for those agencies.
