ADMINISTRATIVE ORDER 01-01 – Order Appointing the Probate Registrar and

Assistant Probate Registrars for the Seventh Judicial District and Delegating the

Authority to the Probate Registrar and Assistant Registrars to Appoint Deputy

Probate Registrars.

The Statutes provide for the appointment of a Probate Registrar for each Judicial District. The

Seventh Judicial District being comprised of six counties makes the effective and efficient

processing of Probate matters with only one Probate Registrar impossible. Accordingly a

different policy to permanently provide for the most efficient method of processing probate

matters in each of the locations of the district is required.

IT IS HEREBY ORDERED, that the Judicial District Administrator shall be the Probate

Registrar for the Seventh Judicial District with all the powers and authority provide by statute or

order to that position. This Probate Registrars shall be able to act in any Probate matter in the

Seventh Judicial District.

IT IS FURTHER ORDERED, that the Clerks of Court of the Delta, Gunnison, Hinsdale,

Montrose, Ouray and San Miguel District and County (Combined) Courts shall be Assistant

Probate Registrars with all the powers and authority of the Probate Registrar as provided by

statute or order to that position. These Assistant Probate Registrars shall be able to act in any

Probate matter in the Seventh Judicial District.

IT IS FURTHER ORDERED, that the Probate Registrar and Assistant Probate Registrars may

appoint Deputy Probate Registrars. These Deputy Probate Registrar may be appointed from the

positions under the operational supervision of the Probate Registrar or Assistant Probate

Registrars. The Deputy Probate Registrars shall only be able to act on matters filed in their

primary location of assignment. This delegation shall be in writing and shall take the form as per

attachment 1 to this order. Revocation of the appointment as a Deputy Probate Registrar shall

be in writing or shall end upon termination of employment in the location where appointed.
