Important information about this form
If you live in the state of Georgia, and were served with a Gwinnett County action,
but do not live in Gwinnett County, you may ask to have the case transferred to the
county where you reside.
NOT
When you may
transfer to your county of residence:
 You have been served with contempt of a Gwinnett County order; or
 You have been served with a divorce and you last resided in Gwinnett
County with your spouse within the past six months.
 You have already signed an Acknowledgment of Service and Consent to
Venue.
What is a Rule Nisi?
A Rule Nisi is a temporary hearing which may be scheduled by the judge in order
to hear from both parties so that the judge can determine which county has proper
venue (location jurisdiction) over your case. Both parties will receive notice of the
hearing, usually in the mail. To check the status of your request for a hearing, you
