I acknowledge that horseback riding or being around horses contains inherent risks of injury or damage to me personally and to

my horse and property. I knowingly assume all risks, whether known or unknown, while riding any horse or being on the

property known as The SPCA Stables at Indian Springs, located at 22400 Indian Springs Rd., Salinas, CA.

In consideration of my being allowed to be on their property or to ride any horse, I waive, release The Monterey County SPCA,

the Indian Springs Homeowners Association and their employees, agent, heirs, executors and assigns from any and all liability

for injury or damage to myself, my animals or my property arising out of my riding a horse or being on their property. This

agreement is binding upon my executors, heirs and assigns.

I expressly waive any rights I may have under California Civil Code, section 1542 which states: “A general release does not

extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if

known by him might have materially affected his settlement with the debtor.”

I agree that if any provision of this release is held by a court of competent jurisdiction to be invalid, void or unenforceable, the

remaining provisions will continue in full force and effect without being impaired or invalidated in any way.

I agree that I will indemnify and hold harmless The Monterey County SPCA, the Indian Springs Homeowners Association,

employees and agents against all claims, demands, and causes of action, including court costs and actual attorney fees and

costs, arising from any proceedings or lawsuits brought by or prosecuted for my benefit, in which this release is upheld.

I acknowledge that I am at least 18 years old and that I have read this Release and Waiver of Liability Agreement and know and

understand its contents.

PARENT OR LEGAL GUARDIAN MUST COMPLETE THIS SECTION

I, the undersigned parent or legal guardian of the above participant, in consideration of my minor’s riding a horse

or being on the Buckeye Ranch property, agree that the terms and conditions of this Release and Waiver of

Liability Agreement shall be binding as to any damage or injury to my minor arising out of such activities.

I acknowledge that I am at least 18 years old and that I have read this Release and Waiver of Liability Agreement

and know and understand its contents.
