Marsy’s Law changed Penal Code section 3041.5 to permit a life inmate to submit a written request to
the Board of Parole Hearings (BPH), to advance his or her parole suitability hearing to an earlier date
if there is a change in circumstances or new information that shows a reasonable likelihood that
consideration of the public and victim’s safety does not require the additional period of incarceration
that was set at your parole suitability hearing.
You (inmate) can request an earlier hearing date by submitting a BPH form 1045(A) – Petition to
Advance Hearing Date (Petition) to the BPH. You can submit this form after being denied parole and
prior to the next hearing. You can only submit one petition every three (3) years after either a denial
of a prior request to advance the hearing, or a denial of parole given at a hearing. You can make one
initial request for an advanced hearing date following a denial of parole at any time, but from then on
you can only submit requests once every three years.
You (inmate) must list below the circumstances you think have changed or new information since
your last parole hearing to show a reasonable likelihood that consideration of the public and victim’s
safety does not require the additional period of incarceration. Attach a copy of the supporting
document(s) such as support letters, job offers, and vocational or education certificates. List them
below including the date you received them. Information listed will be verified by the BPH. Do not
attach original documents you may need at future hearings because they will not be returned to you.
Once the BPH receives your Petition you cannot send additional information to include in your
Petition.

The BPH will give a copy of your Petition to the victim or victim’s next of kin. The BPH will consider
your petition and the comments received from the victim or victim’s next of kin. The BPH will either
grant or deny your request to move your hearing date forward. If the request is granted, your hearing
will be advanced and you will be noticed.
