INSTRUCTIONS FOR FILING A PETITION FOR NAME CHANGE
1.
Before a Petition for Name Change filed with the Circuit Clerk, a notice of the
intended application must be given by publication in a newspaper which is published in the
municipality where the applicant resides, and, if none, in a newspaper published in the
county where the applicant resides.

a. There must be publications for three consecutive weeks with the first publication being at
least six weeks before the Petition is filed.
b. The notice that is published must include the current name of the applicant, the name
sought to be assumed, and the date upon which the Petition will be filed.
c. A Certificate of Publication must be obtained from the newspaper as proof of having
given the required notice.

The Petition to be filed must have the proper caption and include the name the applicant
then held, the name sought to be assumed, the residence of the applicant, the length of
time the applicant has resided in Illinois and the state or country of the applicant’s birth.

On the date of filing, as provided in the published notice, the Petition and Certificate of
Publication must be brought to the Circuit Clerk to be filed and the Clerk will then inform
the applicant which Judge is assigned to hear the case.
5.
The applicant must thereafter contact the office of the assigned Judge for a hearing date
which will be after the date the Petition is filed to allow for the filing of any objection.
6.
On the hearing date, the applicant must appear in court and present evidence to prove the
Petition to the satisfaction of the Judge hearing the case. If an objection has been filed, that
must also be heard and ruled upon by the Judge with either the objector or applicant giving
appropriate notice to the other of the hearing on the objection. If the Petition for Name
Change is granted, the applicant must present to the Judge a proposed Order for Name Change
to be signed by the Judge (which is attached).
