COMMERCIAL LEASE AGREEMENT
COUNTY OF PICKENS

THIS LEASE AGREEMENT is made and entered into this _______ day of _______________,
20___, by and between the University Lutheran Church, hereinafter referred to as Landlord, and
the City of Clemson, hereinafter referred to as Tenant.
WITNESSETH:
1. Description and Terms:
The Landlord, in consideration of continued maintenance, care, and improvements to be
done by tenant on the property and of the covenants, agreements, and conditions
hereinafter contained to be kept, performed and observed by said tenant, does hereby let
and rent unto said tenant the property known as “the Stockman Property” between Sloan
Street and the Clemson Court Apartments in Clemson, South Carolina, to be used and
occupied by said tenant as a parking lot, and for no other purposes, for a term of five (5)
years beginning on the date this lease agreement is signed. This lease may be renewed at
the end of the lease term upon the express written consent of both the landlord and the
tenant, for such term as the parties may agree.
2. Consideration:
The consideration for tenant’s use of the leased property shall be continued maintenance,
care and improvement effected by the tenant on the property.
No other rent or
consideration shall be required of the tenant for the duration of the lease term.
3. Use:
The tenant agrees that the property shall be used only as a parking area to be used by the
general public for public good. The tenant agrees not to allow any nuisance or illegal
activity to exist on the property and to maintain the property in an orderly and neat
condition.
4. Conditions for Use:
a) All expenses associated with the parking area shall be entirely at the expense
of the City of Clemson, including but not limited to the following: 1) legal
costs pertaining to the lease agreement; 2) maintenance and repair to the area;
3) care and replacement as needed for landscaping; 4) utility costs for lighting;
5) patrolling the area for safety and enforcement purposes.
