TYPES OF VARIANCE REQUESTS
There are three types of variance requests and a reconsideration request allowed by state law and the
Horry County Zoning Ordinance. Please note that it is incumbent upon the appellant to prove his/her
case. It is further the responsibility of the appellant to be knowledgeable of all applicable ordinances in as
much as it pertains to their case. Below please find a brief explanation of each:
1. Variance Request
This is a request to vary from the provision(s) of a local regulation. It may be a request to
vary from the provisions of the Zoning, Parking/Landscaping, or Sign Ordinance. This type
of request/variance is site specific.
Examples:
1. Variance from a front yard setback requirement.
2. A request to vary from the number of parking spaces required for a development.
3. Variance from sign regulations.
2. Administrative Appeal Request
This is a request to appeal from a decision made by the local Zoning Administrator. It is an
appeal from an administrative interpretation of the Zoning Ordinance made by the zoning
administrator where the applicant believes that the zoning administrator is in error.
Examples:
1. An applicant disagrees with the zoning administrator regarding whether or not a
particular use is allowed in a given zoning district.
2. The applicant disagrees with the interpretation made by the zoning administrator
regarding the definition of a term.
3. Special Exception Request
This is a request to allow specified uses, which may have a potential negative impact on the
community, provided certain conditions are met.
Examples:
1. To allow commercial mining (as allowed in specific zoning districts).
2. To allow outpatient treatment facilities for alcoholism and drug addiction in the OPI
district only.
3. To allow commercial cruise boats (as allowed in specific zoning districts).
4. Reconsideration Request
This request is for the Zoning Board of Appeals to reconsider a decision made by the Board,
either approving or denying a variance, appeal or special exception. Such request shall be
applied for within 30 days of the original ruling.
FEES
A variance, appeal, special exception or reconsideration application cost is $200.00 and is payable by
cash or check only. A receipt is provided upon payment.
