Instructions for Applying for a New Birth Certificate
Following a Legitimation
LEGITIMATION occurs when the mother was not married at the time of birth, but later marries the
biological father. It may also occur when the mother was married at the time of the child’s birth, but not
to the biological father of the child. In this instance, the mother will need to show a divorce decree or a
court determination stating that the man she was married to is not the biological father of the child.
The following steps are required to obtain a new birth record:
1. An Application for an Amended Birth Record Following Legitimation (VS8) must be completed.
Both biological parents must sign and have their signatures notarized.
2. A certified copy of the Marriage Record is required.
3. A divorce decree or court determination is required if the mother was married at the time of birth
or conception.
4. A check or money order payable to: Treasurer, State of Maine for the fee of $60.00. This fee
includes a certified copy of the new birth record. Any additional copies ordered at the same time
are $6.00 each.
5. All of the above are to be mailed to address in the upper right hand corner of these instructions.
