DO I QUALIFY TO USE THIS INTERVIEW
DIVORCE WITHOUT CHILDREN
This interview is for people without children who want a simple divorce. To qualify
to use this resource, all of your answers to the following questions must be “yes:”

☐ You have or your spouse has lived in Nebraska for the period of one year;

☐ Neither you nor your spouse is pregnant;

☐ No one has filed for divorce already, either in Nebraska or in another state;
☐
☐ There were no children, who still are minors (under the age of 21), born to or
adopted by you and your spouse;
☐
☐ Neither you nor your spouse is a member of the military;
☐
☐ Neither you nor your spouse is a member of the National Guard and currently
on a tour of duty that has lasted 30 days or more;
☐
☐ You and your spouse agree that each should keep what you have currently in
your possession and there is nothing else to divide;
☐
☐ You and your spouse agree that each of you will keep the debts currently in
your own names and there is nothing else to divide;
☐
☐ Neither you nor your spouse had a pension while you were living together;
☐
☐ Neither you nor your spouse is asking the court for alimony;
☐
☐ You and your spouse do not jointly own real estate;
☐
☐ Neither you nor your spouse has contributed to the value of property one or
the other of you owned before the marriage; and
☐
☐ Neither you nor your spouse own a business.
If you answered any of these questions with a “NO” you DO NOT qualify to use
the Supreme Court’s Self-Help forms. When people disagree on issues of property, debt
or alimony they definitely need an attorney to handle the divorce.
The Supreme Court forms are for people who want a “simple” divorce. When
people own property, a business, joint debt, are considering alimony or have a pension
it is likely they will need a property settlement agreement. Issues relating to division of
property and debt are complicated and require the help of an attorney. This is true even
if you agree on these issues.
