Partial Waiver of Lien Rights

The undersigned hereby acknowledges receipt of the sum referenced below in

partial payment of labor, materials, taxes, fees, services, machinery, tools, equipment,

supplies, management, and all other possible items furnished by or through the payee in

connection with the work to the real property listed below.

In consideration of the receipt of this and any prior payments, and upon successful

payment when presented upon Bank West, the payee hereby waives, relinquishes and

forever releases any and all rights it has or may have to a mechanics lien on the real

property with respect to any labor, services, machinery, tools, equipment, materials or

other items provided to date in connection with the construction of improvements on the

said real property for the total payment received. The undersigned further hereby waives

and releases the property owner(s) and Blu SKY Restoration Contractors, Inc. from any

and all claims, demands, rights or causes of action, damage and liabilities of any kind or

nature arising from the provision of labor or materials by the payee with respect to the

construction of any sort to the real property.

The payee hereby warrants and represents to the owner and contractor that all

sums due to all suppliers of labor, services, machinery, tools, equipment, materials and

other items in connection with the construction of improvements on the real property

which have been authorized by the payee and which are included in the payment

acknowledged by this Lien Waiver as well as prior payments have been or will be paid by

the payee and payee hereby indemnifies and holds the owner and contractor harmless

from any liability on account of claims of such suppliers or subcontractors. Payee further

promises to notify Blu SKY of any subcontractors and to provide lien releases for same.

Payee will be completely responsible to owner(s) and Blu SKY Restoration Contractors,

Inc. for any and all administrative, management, and legal fees associated with any

liability on account of such suppliers or subcontractors which payee fails to compensate.

This is a Partial Lien Waiver only for the amount paid to day and conditioned upon

successful payment by Bank West upon deposit.
