4CONSTRUCTION NOISE WAIVER PROCEDURES
Per Chapter 36-6 of the City of Miami Charter and Code, noise from a construction site is prohibited between the hours of 6:00 PM
and 8:00 AM the following day, on weekdays, or at any time on Sundays or holidays. A noise waiver can be approved by the City
Manager or a NET (Neighborhood Enhancement Team) Director, as designee to approve at his discretion any and all Construction
Noise Waivers on behalf of the City Manager and the City of Miami. This waiver is required for extended working hours during the
work week, weekends and Federal Holidays.
Steps required in receiving a Construction Noise Waiver Include:
STEP 1:
A Construction Noise Waiver request and notification survey form must be received in person or e-mail to:
at least 10 business days prior to date of request.

Applicant must notified abutting property owners as per the attached exhibits (pages 3 and 4) via
and
provide the Neighborhood Enhancement Team (NET) office with the USPS receipts of Survey Letters sent to residents, business,
and condominiums affected by the Noise Waiver. The forms shall be submitted with the Construction Noise Waiver request (page
2).
STEP 3:
The Noise Waiver request will be reviewed by the NET Director for approval and signature. Once approved, it will be provided
electronically to the requestor with copies to the corresponding Police Commander, Code Compliance and Commissioner’s Office,
NET Administrator and staff. If the request is denied, the Contractor or a Developer will be notified.
STEP 4:
If approved, the Construction Noise Waiver, letter must be on site at all times and available as needed by any Police officer and/or
Code Compliance inspector.
