Application for Suspension of Enforcement Order
This application will not waive the Enforcement Order fee; it will only suspend enforcement action for 28 days.
An application for the suspension of an enforcement order can only be made in respect of enforcement orders issued for
infringement notice penalties pursuant to section 44 of the Monetary Penalties Enforcement Act 2005 for which a
deemed conviction pursuant to section 20(1)(c) applies.
If your enforcement order relates to a monetary penalty that was imposed by a court, unless the original order for the
payment of the monetary penalty is quashed you are liable for the monetary penalty and the associated enforcement
order fee.
YOU CANNOT MAKE APPLICATION TO SUSPEND SUCH ENFORCEMENT
ORDERS.
The suspension of an enforcement order does not affect the original infringement notice. Applications will not be
considered by the Director unless made within a period of no greater than 6 months following the service of the order
You must within 28 days:
Apply to the issuing authority for withdrawal of the infringement notice; or
Pay the monetary penalty including the enforcement order fee in full; or
Apply to the director for a variation of payment conditions for all outstanding penalties including
enforcement order fees; or
Apply to the court under s.40 of the Monetary Penalties Enforcement Act 2005 for the deemed conviction to
be set aside.
By submitting this application you acknowledge that unless the original penalty is withdrawn you are liable for
and will be required to pay the outstanding monetary penalty including the enforcement order
fee.
