WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT

KNOW ALL MEN BY THESE PRESENT this __________ day of ___________________, 2009,

that the undersigned, its, his or her heirs, executors, administrators and assigns do/does hereby

agree to defend, indemnify and hold harmless Caernarvon Township, Berks County its agents,

representatives, employees, officers, and supervisors, from any and all liability whatsoever,

including attorneys’ fees arising by reason of any damage to property or injury to person(s),

including death, from the use of the parks, facilities, or property of Caernarvon Township, Berks

County, Pennsylvania, pursuant to a Facility Usage Permit, whether such injuries to person(s) or

damage to property are due to or claimed to be due to any condition of the property, activities of

others, any active or passive negligence of Caernarvon Township, Berks County, its agents,

representatives, employees, officers, and supervisors, or from any other cause whatsoever.

The undersigned further agrees that it, he, or she shall, at the direction of Caernarvon

Township, defend Caernarvon Township, provide counsel and bear all costs and expenses in

the defense of any suit or claim so arising hereunder.
