RELEASE AND WAIVER OF LIABILITY AGREEMENT

All participants in its Monday evening social run, Soul Runners club and other related

activities (“the Event”) sponsored by Trinity Brewing Co & The Colorado Running Co

are required to assume all risk of participation in the Event by signing this Release

and Waiver of Liability Agreement.

The undersigned runner (“Runner”) on behalf of himself/herself and on behalf of the

Runner’s personal representatives, assigns, heirs, and executors hereby fully and

forever releases, waives, discharges, and covenants not to sue Trinity Brewing Co

and/or The Colorado Running Co, it’s shareholders, owners, employees, servants,

successors and assigns (“Releasees”) from any and all liability to the Runner and

his/her personal representatives, assigns, heirs, and executors for all claims, or causes

of action on account of personal injury, damage of property, loss of services, medical

expenses, contributions, indemnifications, losses, or damages of any and every kind

whatsoever whether caused by the passive or active negligence of all or any of the

Releasees or otherwise in connection with the Runner’s participation in the Event.

The Runner represents that he/she is in good physical condition and is safely able to

participate in the Event. The Runner is fully aware and understands the risks and

hazards inherent in participating in the Event including, without limitation, weather

conditions, traffic, and the condition of the road, all such risk being known and

appreciated by the Runner. The Runner assumes all risks of loss(es), damages(s), or

injury(ies) that may be sustained by him/her while participating in the Event.
