Release of Lien – Partial
A Partial Release of Lien is prepared by a lienor and presented to an owner to indicate
that they have been paid for the provision of labor, services or materials through the date
noted on the Release.
Acknowledging payment relinquishes their lien rights through that period of time.
An owner must insist upon receiving this Partial Release before making progress
payments on their construction contract.
The owner can ask the contractor to obtain the Releases for him, but under no
circumstances can a contractor prepare and sign a Release on behalf of a lienor.
Make certain that you receive releases for anyone that has served you a Notice to Owner.
Make certain that you receive releases from anyone who is still within the period of time
to serve a valid Notice to Owner (45 days from first furnishing of labor, services or
materials).
Make certain that you receive one from your prime contractor as well.
