Section 328.05, Florida Statutes, provides that whoever knowingly makes a false statement in any application or
affidavit required under the provisions of Chapter 328, or in a bill of sale or sworn statement of ownership or
otherwise commit a fraud in any application is guilty of a felony of the third degree, punishable as provided in s.
775.082, 775.083 and 775.084.
Application Instructions: In order to transfer said title and registration to the above vessel, forward this
completed affidavit to the local county tax collector’s office. In addition to this affidavit, include: (a) the
current original title certificate; (b) A form HSMV 82040, Application for Certificate of Title with/without
Registration; (c) a copy of the applicable contract upon which said claim of possession and ownership is made
or a copy of the court order or judgement.
