ORDER GRANTING STAY OF EXECUTION OF SENTENCE
THIS CAUSE came on for consideration of a motion, ore tenus, by Defendant, for a stay of
execution of sentence to allow Defendant time to perfect an appeal to County Court and the Court being
satisfied that it has jurisdiction of the parties and the subject matter hereby ORDERS:
1.
Execution of sentence in this cause is stayed until 8:30 A.M. on ______________ (hereinafter
“Execution of Sentence Date”) at which time the Defendant must reappear in Justice Court for execution
of sentence unless he/she has (a) perfected an appeal in accordance with URCCC 5.04 and delivered to
the Justice Court Clerk a copy of the County Court file-stamped notice of appeal or (b) paid the entire
fine including costs and assessments and completed any of the other terms of sentencing (except any
unsupervised probation and any suspended portion of the sentence).
2.
On the Execution of Sentence Date, a warrant for the arrest of the Defendant for contempt of court
shall be issued if the Defendant fails to timely reappear in Justice Court and has failed to:
(a) perfect an appeal in accordance with URCCC 5.04 and deliver to the Justice Court Clerk a copy
of the County Court file-stamped notice of appeal; or
(b) pay the entire fine or complete any of the other terms of sentencing (except any unsupervised
probation and any suspended portion of the sentence).
3.
If the Defendant perfects an appeal to County Court and the appeal is subsequently remanded back
to Justice Court, (a) the Defendant shall reappear in Justice Court for execution of sentence no later
than ten (10) days after entry of the County Court order remanding the case back to Justice Court; and
(b) if the Defendant fails to so timely reappear in Justice Court, a warrant for the arrest of the Defendant
for contempt of court shall be issued.
