INSTRUCTIONS

State and Federal regulations allow the commercial driving test to be waived under certain conditions for drivers who are regularly

employed in a job requiring the operation of a commercial motor vehicle. Please review the following requirements. If you meet these

requirements, certify below and have your employer complete the back of this form. NOTE: This waiver may only be claimed one time.

This certification may only be completed if you are converting from a non-CDL to a CDL or when applying for an original Texas CDL and

coming from another state. Any later transaction, advance in grade, removal of restriction, addition of an endorsement etc., other than a

duplicate may require you to complete a skills test.

CERTIFICATION

I certify that:

1. I am currently licensed.

2. During the two-year period immediately prior to applying for a Commercial Driver License, I:

a. Have not had more than one license at any one time.

b. Have not had any license suspended, revoked, or cancelled.

c. Have not had any convictions in any type of motor vehicle for the disqualifying offenses contained in 49 CFR,

Part 383.51(b)(2), which are as follows:

1) Driving while intoxicated

2) Driving under the influence of drugs

3) Blood/breath test refusal

4) Failed to stop and render aid

5) Felony involving use of a commercial motor vehicle

6) The use of a commercial motor vehicle in the commission of a felony involving manufacturing, distributing

or dispensing a controlled substance

d. Have not had more than one conviction in any type of motor vehicle for the following serious traffic violations:

1) Speeding 15 mph over the limit

2) Reckless driving

3) Following too close

4) Unsafe lane change

5) Driving a commercial motor vehicle without a CDL

e. Have not had a violation of the law relating to traffic control, arising in connection with a fatal accident (excluding

parking, weight, and vehicle defect violations).

Have not violated any state or local law relating to motor vehicle traffic control, arising in connection with any traffic

accident and have no record of an accident in which I was at fault.

3. Furthermore, I am regularly employed in a job requiring the operation of a commercial motor vehicle and that:

(check the appropriate box)

a. I have previously taken and passed a skills test given by a state with a classified licensing and testing system and

the test was behind-the-wheel in a representative vehicle for my driver license classification; or

b. I have operated for at least two years immediately preceding application for a commercial driver license, a vehicle

representative of the commercial motor vehicle I operate or expect to operate.

I CERTIFY THAT I HAVE READ, UNDERSTAND AND MEET THE PRECEDING REQUIREMENTS TO WAIVE A COMMERCIAL

DRIVER LICENSE DRIVING SKILLS TEST.
