12.
Custody:
Upon the basis of facts that have arisen since the
prior Judgment, or that were unknown to the Court at the time of the prior
Judgment, a change has occurred in the circumstances of the child(ren) or
his/her/their custodian and the modification requested herein is necessary
to serve the best interests of the child(ren). Custody should be modified as
follows:
Check one of the following:
____ That the parties be awarded joint legal custody and joint physical
custody of the minor child(ren) and that the address of (Petitioner/Plaintiff)
or (Respondent/Defendant) should be designated as the address of the
child(ren) for residential and educational purposes in accordance with the
terms of the Parenting Plan attached hereto.
____ That the parties be awarded joint legal custody of the minor child(ren)
and that sole physical custody of the minor child(ren) be awarded to
(Petitioner/Plaintiff) or (Respondent/Defendant) in accordance with the
terms of the Parenting Plan attached hereto.
____ That (Petitioner/Plaintiff) or (Respondent/Defendant)) be awarded sole
legal custody of the minor child(ren) and sole physical custody of the minor
child(ren) in accordance with the terms of the Parenting Plan attached
hereto.
13.
Visitation or Contact Schedule:
Modification of the prior
Judgment as requested herein below would serve the best interests of the
child(ren). Parenting time should be modified as set forth in the Parenting
Plan attached hereto, which is in the best interests of the child(ren).
14.
Child Support:
A substantial and continuing change of
circumstances has occurred since the entry of the original Judgment that
makes the prior child support orders unreasonable. Child support has been
calculated according to Form 14. A Parenting Plan and Form 14 calculation
are attached as exhibits ______ and ______.
Modifying child support as
follows is in the best interests of the child(ren):
Check any of the following that are applicable:
____ The existing amount of child support was based upon the presumed
amount pursuant to the child support guidelines AND the current presumed
amount of child support would result in a change of child support from the
existing amount by twenty percent or more.
