Property of Brazoria County, Texas, relative to the Property, but only to the extent the same are

applicable to and enforceable against the City of Pearland.

It is hereby understood, and by the acceptance of this instrument it is recognized, that Grantors

reserve all of the oil, gas and sulphur in and under the land herein conveyed but waive all rights

of ingress and egress to the surface thereof for the purpose of exploring, developing, mining or

drilling for same.

TO HAVE AND TO HOLD the Property, together with all and singular the rights and

appurtenances thereto in anywise belonging unto the said Grantor, its successors and assigns,

forever, and Grantor does hereby bind itself, its successors and assigns, to Warrant and Foreever

Defend all and singular the said premises unto the said City of Pearland, its successors and

assigns, against every person whomsoever lawfully claiming, or to claim the same, or any part

thereof, subject to reservations from and exceptions to warranty and conveyance described

above.
