Instructions for Use of Form
Who May Complete the Form
An authorized agent employed by a PA on-line dealer auction, PIADA or PAA.

When May the Form Be Used
This form is to be used only when all the following conditions apply:
v
1. The vehicle owner is a PA dealer, and is the owner on the PA vehicle record.
2. The vehicle is financed, and a lien is recorded on the PA vehicle record.
3. The current PA title is an ELT (Electronic Lien and Title).
4. The vehicle is to be offered for sale at a PA dealer auction.
Completion of Form
All sections of the form must be completed. No fields may be left blank.

The form must be signed by a representative of the lienholder in the presence of the agent
v
who issues the title.
The form cannot be partially completed by the lienholder, then mailed, faxed or e-mailed to
v
the agent.
The signer for the lienholder must present documentation from the lienholder authorizing the
v
signer (by name) to sign the form releasing liens on behalf of the lienholder.
The signer for the lienholder must present proof of identification to verify identity.

If an employee of the on-line dealer auction, PIADA or PAA is designated as an agent of
v
the lienholder, a Power of Attorney from the lienholder is required. A photocopy of the Power
of Attorney must be attached to this application.
Issuance of Title
Upon completion of the form, a title is to be printed on-line immediately and given directly to
v
the representative of the dealer who is named on the title as the vehicle owner.
The representative of the dealer/owner must present documentation from the dealership,
v
authorizing the representative (by name) to take possession of the title from the agent.
The representative of the dealer/owner must present proof of identification to verify identity.
v
The agent processing the title using this form may not be the same person signing for the
v
lienholder using a Power of Attorney.
Documentation
Agents must maintain copies of the following documentation, along with a copy of the
v
completed Form MV-38A, in their on-site agent files:
1. Copy of the lienholder's authorization letter
2. Copy of the dealer/owner's authorization letter
3. Copy of ID presented by lienholder's representative
4. Copy of ID presented by dealership's representative
5. Copy of Power of Attorney, if applicable
