Title applications, assignments on certificates of title and documents used to support the issuance of certificates of title
should be completed and signed according to the legal name(s) of the owner(s) in order for certificates of title to be
issued in the legal owner(s) name(s). For a person, the legal name is the name on the driver’s license. For a business,
the legal name is the name on the business license, articles of incorporation or other document that establishes a
business name. A title to a motor vehicle is like a deed to a home. The same care and concern used in real estate
transactions should be exercised in motor vehicle title transactions to make sure signatures, title assignments and title
applications are completed in the legal owner’s name whether or not the owner is the buyer (current owner) or the seller
(previous owner) of the motor vehicle.
In our experience, when title applications are signed or title assignments are made and signed, legal names are not
consistently used. This presents two challenges to the Motor Vehicle Division and County Tag Offices who must
examine title applications and documents to make sure that motor vehicle ownership is legally transferred and
documented while at the same time provide a level of customer service that meets or exceeds expectations.
In order to meet these challenges, a ‘One And The Same Affidavit’ (Form T-227) has been developed. This affidavit
must be completed and submitted whenever a legal name and signature; or, legal name and title assignment; or,
signatures or title/document assignments do not provide the Motor Vehicle Division and County Tag Offices
sufficient documented proof that a transfer of ownership or title application will withstand a legal challenge of the
documents accepted to issue a title. For example, you may know that Mrs. Missy Jones is Melissa Ann Jones;
however, the Motor Vehicle Division and County Tag Offices do not. So, if a judgment has been obtained in the name
of Mrs. Missy Jones and the title application is completed in her legal name, Melissa Ann Jones, the ‘one and the
same affidavit’ must be completed and submitted with the title application and other supporting documents, if Mrs.
Missy Jones and Melissa Ann Jones are the same person.
This affidavit (Form T-227) can not be used in place of a power of attorney form. If John Smith signs Mary Jones’
name or John Smith signs his name on a title application in Mary’s name or title assigned to Mary, she must complete a
power of attorney form saying that John Smith can sign for her and the power of attorney form must be submitted with
the title application and other documents. This affidavit can not be used to explain any differences in a motor vehicle
dealer’s name. This affidavit can not be used in place of a divorce decree; marriage certificate or court ordered name
change. In other words, this affidavit will not be accepted to explain any differences in a last name.
If the legal name contains a suffix like Jr., Sr., II, III, IV, etc. and a required signature or assignment does not have a
suffix, then this affidavit (Form T-227) should be completed and submitted with the application for title and supporting
documents. Additionally, if a required signature or assignment has a suffix, however, the legal name (driver’s license
name) does not have a suffix, this affidavit should be submitted with the application for title and supporting documents.
This affidavit will not be accepted, however, when the legal name has a suffix and a required signature or assignment
has a different suffix. Example (1): John Doe JR is legal name. Documents signed or title assigned or application
completed in the name of John Doe. In this example, Form T-227 will be accepted in place of obtaining new signatures
and/or assignments. Example (2): John Doe IV is the legal name. Documents signed or title assigned or application
completed in the name of John Doe III. In this example, Form T-227 will not be accepted; new signatures and/or
assignments would have to be obtained.
The first three parts of the affidavit must be completed in their entirety by a person that has personal knowledge of the
facts noted in the affidavit. The vehicle owner, the security interest holder or lien holder, a judgment creditor, or the
seller can complete form T-227. A person named in a Power of Attorney can also submit this affidavit. The person
completing the ‘one and the same’ affidavit bears legal and financial responsibility should the facts in the affidavit be
successfully challenged in an administrative or court proceeding. The affidavit must be notarized and the notary public
must complete all information in Part 4 of the affidavit.
If this affidavit is not submitted to document legal name discrepancies in signatures and title assignments, new
documents and/or signatures without discrepancies must be obtained. If the discrepancies in the signatures and/or
assignments are not acceptable to the Motor Vehicle Division or County Tag Offices even with the submission of Form
T-227, new documents and/or signatures must be obtained.
