Motion For A Fair Trial Venue Change Form - Harris County, Texas

Instructions: Venue is the place where the lawsuit should be filed. Venue may be proper, but a party may believe that a fair trial in a specific precinct or before a

specific judge is not possible. A sworn motion to transfer venue may be filed setting out the belief that a party cannot get a fair trial either in the specific precinct or

before a certain judge. This motion must be supported by the sworn statements of two other credible persons. The motion must specify whether a change of place for

trial is requested or the party is requesting a change of judge. A motion to transfer venue for these reasons must be filed no less than 7 days before trial.

If the party is seeking a change of judge, the judge will exchange benches with another justice of the peace. If the party is seeking a change in location, the case will be

transferred to the nearest justice court in the county. Rule 502.4
