several medical conditions and has provided evidence that she received Social Security benefits in

2006. This documentation does not, however, show that appellant was unable to attend to her own

personal needs and activities of daily life, such as personal hygiene or nutritional needs, as needed to
4
demonstrate that she was medically incapacitated during the 2005 claim filing period, which was July
5
1, 2005, through June 30, 2006. Respondent requested that appellant provide supporting
6
documentation in the form of a doctor’s statement explaining the exact dates of her medical
7
incapacity and showing that appellant’s medical conditions were severe enough to prevent her from
8
timely filing her claim. Appellant has not provided any documentation to this effect. Accordingly,
9
appellant has not shown medical incapacity that would permit the acceptance and consideration of
10
her late filed 2005 claim.

For the foregoing reasons, respondent’s action is sustained.
