KNOW ALL MEN BY THESE PRESENTS, That the undersigned ___________________of

____________________, as surety, are held and firmly bound unto the State
of Alabama in the sum of ______________ (Dollars (

of the United States of America for the payment of which will and truly be

hereby
jointly

bind

administrators, executors, successors, and assigns.
THE CONDITION OF THE ABOVE OBLIGATION IS SUCH, That Whereas the above
named principal has filed with the Alabama Surface Mining Commission an
application to secure a permit to engage in surface coal mining operations
in the State of Alabama; that in said application the principal stipulates
that

will
be
affected
by
surface
coal
mining
operations.
This bond shall remain in full force and effect throughout life and
renewals
of
said
permit
and
until
the
obligation
of
reclaiming
the
affected lands has been satisfied in accordance with the Alabama Surface
Mining Control and Reclamation Act of 1981, and other applicable law and
regulations of the State of Alabama.
Now, if the said ________________ shall faithfully perform all of the
requirements of the said laws, regulations, and conditions of the permit,
then this obligation shall be void; otherwise, it shall remain in full
force
and
effect,
unless
forfeited
by
the
Commission
pursuant
to
applicable law and regulations.
This bond shall not be cancelable by the surety at any time for any
reasoning
including,
but
not
limited
to,
non-payment
of
premiums,
bankruptcy, or insolvency of the permittee during the period of liability.
The surety shall give written notice to the permittee and to the Alabama
Surface Mining Commission within ten (10) days of any notice received or
action filed alleging the insolvency or bankruptcy of the surety, or
alleging any violations of regulatory requirements which could result in
suspension or revocation of the surety's license to do business.
Should the surety become unable to fulfill its obligations under this bond
for any reason written notice shall be given to the permittee and the
Alabama Surface Mining Commission within ten (10) days of the occurrence
of such event.
