SMALL CLAIMS INSTRUCTIONS
YOU WILL NEED THE FOLLOWING FORMS TO FILE YOUR SMALL CLAIMS ACTION:
1.
INFORMATION FOR THE SMALL CLAIMS PLAINTIFF (Form SC-100-INFO)
(2 pages).
2.
PLAINTIFF' CLAIM AND ORDER TO GO TO SMALL CLAIMS COURT
(Form SC-100) (5 pages). This form must be completely filled out. You may type, neatly
print, or use the tillable forms online. It must be signed and dated by the party(s) bringing the
action. A separate check or money order must be remitted with each claim you file, made
payable to "Clerk, Superior Court." Credit card payments can be made in person but not on
the telephone (see fee schedule SCF 38 attached). Please attach a note indicating first and
second choices of the hearing time you prefer: 8:30am, 1Oam,
11am, 1:30pm, 5:30pm or 6:30pm.

If you want this office to mail your claim to the defendant by Certified Mail, one form
must be completed and returned to each defendant. Enclose a check for $15.00
payable to "Clerk, Superior Court" for each defendant you wish to serve. Do not fill in the
section at the bottom headed "Clerk's Certificate of Mailing Claim by Certified Mail."
NOTE:
If the person to whom the Certified Mail is addressed does not sign, or if the signature
is clearly by someone other than the addressee, such service is invalid. If the signature is
illegible, the court may (at the time of the hearing) review the signature and hold that it is not
acceptable, take the case off calendar, and ask that you re-serve the claim prior to a new court
hearing
date.
Please call the office or check the court's website at
not less than 20 days after filing your claim to learn if the defendant was properly served.
8.
FICTITIOUS BUSINESS NAME (Form SC-103) (1 page).
If you, as plaintiff, are suing under a fictitious business name, this form
must be completed and returned to this office.
