ORDER ALLOWING PAYMENT PLAN AND REQUIRING DEFENDANT

TO APPEAR IN COURT IF ANY PAYMENT IS NOT TIMELY MADE IN FULL

THIS CAUSE came on for consideration of a motion, ore tenus, by Defendant, to allow a payment plan and the Court

being satisfied that it has complete jurisdiction hereby ORDERS:

The Defendant shall truthfully complete the payment information form provided by the clerk. The Defendant shall

also provide the Court with written notice of his/her address and home telephone number and work telephone number within five

(5) days of a change in his/her address or home telephone number or work telephone number.

Beginning on the ____ day of _______________, 20___, the Defendant shall pay $__________________________

on the fines and costs incurred on the above referenced charge(s) and such payments shall continue to be paid as follows:

on the _____ day of each month thereafter or

until the total amount due is paid in full. The suspension of any jail time on each of the above-referenced charges shall, in

addition to any other ordered conditions, be subject to timely payment of all Justice Court fines and costs.

For the convenience of the Defendant and the Court, a Defendant who will be making payments on more than one

charge over a specified period of time shall complete one payment application which shall be applicable to each charge as if

completed separately for each charge.

The Court hereby orders that payments made by the Defendant on the total amount due be first applied to the costs

associated with the above-referenced charges. After all costs are paid in the above-referenced charges, payments made on the

total amount due shall be applied to the charge that has the lowest remaining balance.

If the Defendant fails to make any payment timely and in full,

(a)

the Defendant shall appear at 8:00 a.m. in the Rankin County Justice Court on the second Monday of the

month such payment is due to show cause why he/she should not be held in Contempt of Court and the Defendant shall not

receive any further notice to appear because he/she shall today be given a copy of this order and such copy shall constitute notice

of such hearing; and

(b) if the Court determines that the Defendant is guilty of Contempt of Court on one or all of the above-referenced

charges, the Defendant may be sentenced on such charges to the Rankin County jail for not more than six (6) months and fined

not more than one thousand dollars ($1,000) and may have any suspended jail time revoked and all jail time may be consecutive.
