MANAGEMENT PRACTICES FOR
CASUAL USE PLACER OPERATIONS (43 CFR 3809)
1.
Comply with all federal, state, and local laws, regulations, and requirements.
2.
Obtain owner permission prior to conducting activities on any mining claim.
3.
Limit camping to 14 total days within any 30-day period and to areas designated by the
authorized officer.
4.
Do not operate vehicles in waterways, wetlands, or marshy areas.
5.
Stay on existing and designated roads and trails.
6.
Conduct all activities within stream channels at least two feet away from stream banks and inter-
river islands with established vegetation.
7.
Do not undercut or excavate the tops of stream banks.
8.
Refuel motorized equipment at least 20 feet away from waterways and adjacent wetlands.
9.
Store fuel and other hazardous materials away from flood-prone areas.
10.
Do not disturb material too large to be moved by hand or hand tools.
11.
Do not disturb more than two cubic yards of material per day.
12.
Ensure that activities do not interfere with or harm the continued existence and use of any BLM,
county, state, or federal designated recreation site, roadway, or boat ramp.
13.
Ensure that activities do not jeopardize the continued existence or habitat of any threatened or
endangered species or species proposed for listing.
14.
Ensure that activities do not adversely impact properties listed or eligible for listing on the
National Register of Historic Places.
15.
Immediately report any resource damage or adverse impacts to the BLM.
16.
If using an anchoring system, do not span waterways or restrict the free passage of water craft.
17.
Fill all excavations (including those within the stream channel) within 14 days of completing
activities.
18.
Keep the worksite and surrounding area free of litter at all times and thoroughly clean the area
prior to departure. Remove and properly dispose of all trash and debris.
Dredging:
19.
Ensure that suction dredging equipment does not exceed a 4-inch diameter intake nozzle and a
10-horsepower motor.
20.
Limit dredging activities to only one site at any one time.
21.
Conduct dredging activities at least 100 feet away from bridge supports.
On BLM-administered lands subject to 43 CFR 3809 regulations, any surface-disturbing activity greater
than that defined as casual use is required to have either a Mining Notice or a Plan of Operations and a
reclamation bond.
Any operation greater than casual use within the San Miguel Area of Critical
Environmental Concern (ACEC) must have an authorized Plan of Operations and a reclamation bond.
