c) from my own knowledge and investigations I am aware of the risks, dangers, hazards and conditions associated with

participation in the Great Toboggan Ride. On behalf of myself and my heirs, executors, administrators and personal

representatives I freely and irrevocably accept and fully assume all and the entire responsibility and liability for all and

any negligence, risks, dangers, hazards, conditions, liabilities and costs, including any temporary or permanent personal

injury, disability or property damage, or of my death, or any other loss, damage or injury of any nature whatsoever

which may result from either or both of:

i) my participation in the Great Toboggan Ride; and,

ii) any actions or omissions of mine which may cause damage to other persons or individuals or to property while

participating in the Great Toboggan Ride.

d) I hereby acknowledge and agree that my participation in the Great Toboggan Ride requires the use of protective sporting

equipment, including, but not limited to, cold weather gear, a mouthguard, gloves, boots, a helmet and faceguard

and a cushioned seating pad, all of which I am solely responsible for providing for my own use. If I choose to

participate without the use of any or all of the foregoing items then I will do so entirely on my own responsibility and

liability, and Lakeland shall have no duty or obligation to ensure that I have used or am using any or all of such items if I

do participate, and Lakeland shall not be deemed negligent or held liable in any way for any damages, injury or for my

death that I may suffer in such circumstances.

e) If Lakeland provides me with all or any of the foregoing items for my use, I hereby irrevocably agree and do hereby

accept sole and exclusive responsibility and liability for determining whether any such item as may be provided is safe

for use and adequate and fit for the purpose for which it was provided to me, and I do hereby irrevocably exonerate and

release Lakeland, absolutely, from all and any liability therefor.

RELEASE OF LIABILITY, WAIVER OF CLAIMS AND INDEMNITY AGREEMENT:

In consideration of Lakeland College permitting me to participate in the Great Toboggan Ride I irrevocably agree and do

hereby:

1. waive, release and discharge, absolutely, any and all claims and damages whatsoever that may arise against Lakeland in

regard to the Great Toboggan Ride, including, but not limited to, claims, demands, lawsuits, liabilities and costs arising

through negligence, breach of contract or breach of any statutory duty of care, or any other duty whatsoever either

express or implied; and,

2. waive, release and discharge, absolutely, Lakeland from any and all liability for any loss, damage, death, injury, cost or

expense that I may suffer, or that my heirs, next of kin, executors, administrators, and personal representatives may

suffer as a result of my participation in the Great Toboggan Ride, due to any cause whatsoever, including, but not limited

to, negligence, breach of contract or breach of any statutory duty of care, or any other duty whatsoever either express or

implied; and,

3. hold harmless and indemnify Lakeland from any and all liability for any loss, damage, death, injury, cost or expense that

I may suffer, or that any other person or individual may suffer resulting from my participation in the Great Toboggan Ride

due to any cause whatsoever, including, but not limited to, negligence, breach of contract of any statutory duty of care,

or any other duty whatsoever either express or implied; and,

4. agree that this Release, Waiver and Indemnity shall be irrevocable and effective and binding on myself, my heirs, next of

kin, executors, administrators, and personal representatives in the event of my injury, death or incapacity.

ADDITIONAL GROSS NEGLIGENCE RELEASE:

This Gross Negligence Release is in addition to and not in substitution for the Release, Waiver and Indemnity provided in the

foregoing pages of this document.

In consideration of my being permitted to participate in the Great Toboggan Ride, I expressly and irrevocably do hereby release and

discharge Lakeland, absolutely and forever, from all and any liabilities, costs, expenses, demands and lawsuits, and any other

claims of any nature whatsoever, including, without restricting the generality of the foregoing, all claims for damages, costs,
