Agreement   to   l ease  
7.     Overtenant   sublets  the   p remises   to   t he   S ubtenant   for   t he   T erm.  Overtenant   states  
and  pay   r ent:  
that  it   h as   t he  authority   to   d o   s o.     T he  Subtenant   agrees  to  pay  the  Rent  and  other  
charges  as   r equired   in   t he   S ublease.   The   S ubtenant   agrees  to   d o   e verything   required  
in   t he   S ublease.  
 
Subject  to:    
8.     The   S ublease   is   s ubject  to   t he  Over-­‐ -­‐ -­‐ L ease.   I t   i s   a lso  subject  to   a ny  agreement   to   w hich  
the   O ver-­‐ -­‐ -­‐ L ease   i s   s ubject.  The  Subtenant   has   r ead  and  initialed   the   O ver-­‐ -­‐ -­‐ L ease   a nd  
will   n ot  violate  it   i n   a ny  way.  
 
Overtenant’s  
9.     The   O ver-­‐ -­‐ -­‐ L ease   d escribes   the  Landlord’s   duties.  The   O vertenant   is   n ot   o bligated   to  
duties:  
perform  the   L andlord’s   duties.  If   t he   L andlord   fails   t o   p erform,   the   S ubtenant   must  
send  the   O vertenant   a   n otice.  Upon  receipt  of   t he   n otice,  the   O vertenant   shall  then  
promptly   notify  the   L andlord  and  demand   that   t he   O ver-­‐ -­‐ -­‐ L ease   a greements   be   c arried  
out.   T he   O vertenant   shall  continue  the   d emands   until  the   L andlord   performs.  
 
Consent:    
10.     The   L andlord’s   consent  to   t he  Sublease   is   r equired   and  this  consent  must  be   r eceived  
within  10   d ays  from  the   d ate  of   t his   S ublease.   If   t he   L andlord’s   consent  is   n ot   r eceived  
within  this   t ime,  the   S ublease   will   b e   v oid.  In   s uch  event  all   p arties  are   a utomatically  
released   and  all   p ayments   shall  be   r efunded   to   t he   S ubtenant.  
 
No   A uthority:    
11.     The   S ubtenant   has   n o   a uthority   to   c ontact  or   m ake  any  agreement   with  the  Landlord  
about  the   p remises   of   t he   O ver-­‐ -­‐ -­‐ L ease.   T he   S ubtenant   may  not   p ay  rent  or   o ther  
charges  to   t he   L andlord,   but   o nly  to   t he   O vertenant.  
 
Successors:    
12.     Unless  otherwise   stated,  the   S ublease   is   b inding  on   a ll   p arties  who  lawfully   succeed   to  
the   r ights  or   t ake  the   p lace  of   t he   O vertenant   or   t he   S ubtenant.   Examples   are   a n  
assign,  heir,  or   l egal  representative   such  as   a n   e xecutor   of   y our  will   o r   a dministrator  
of   y our  estate.  
 
Changes:    
13.     This  sublease   can  be   c hanged   only  by   a n   a greement   in   w riting  signed  by   t he  parties  of  
the   S ublease.  
 
Cancellation:    
14.     Notwithstanding   any  other  provision   of   t he  Sublease,   the   O vertenant   shall  have  the  
right  for   a ny  reason  to   t erminate   the   S ublease   upon  30   d ays  notice  to   t he   S ubtenant.  
Said  notice  may  be   s erved  by   d elivery  to   t he   S ubtenant   by   o vernight   mail  or   p ersonal  
delivery   to   t he   S ubtenant.   If   t he   S ublease   is   t erminated   pursuant   to   t he   p rovisions   of  
this   p aragraph,   then  the   S ubtenant   shall  vacate  by   t he   d ate  set   f orth  in   s aid  Notice  
(the  "Vacate   Date")  and  if   t he   S ubtenant   fails  to   v acate  by   t he   V acate  Date,  then  in  
addition   to   a ll   o ther  remedies,   the   O vertenant   shall  be  entitled   to   r ecover  all   l egal  
fees   i ncurred   in   e nforcing   these  terms,  including   reasonable   attorneys   fees   a nd  costs.  
In   a ddition,   the   S ubtenant   shall  be   l iable  for   u se   a nd  occupancy   in   t he   a mount  of   $ 250  
per   d ay  for   e ach  day  after  the   V acate  Date  until  the   O vertenant   recovers   possession  
of   t he   a partment.
