b) Twenty-one (21) of the thirty-nine (39) parking spaces will be subleased by

tenant, proceeds from said subleasing to go to tenant; the remaining spaces

will be open to the public.

c) University Lutheran Church may from time to time need space in the parking

lot for non-parking related activities. University Lutheran Church may obtain

the temporary use of any, or all, of parking spaces 1-15 upon 30 days written

notice to the City of Clemson. These spaces are designated as “Leased

Parking” on EXHIBIT A.

Spaces temporarily recaptured by University

Lutheran will be equitably redistributed among the lots public parking

inventory.

d) Leased and public spaces will be available to the landlord on Sundays and on

Clemson University home football game days.

e) In addition to Sundays, the eighteen (18) unassigned public spaces will be

available to the landlord for special events and circumstances, such as

weddings and funerals. The City, with proper notice, shall barricade (cones)

the public spaces for special occasions. Access to the leased spaces must be

maintained Monday-Saturday between the hours of 8:00am and 5:00pm.

f) The City will be responsible for providing effective enforcement of any

parking regulations.

g) The City will be responsible for maintaining the lot for the purpose of keeping

the property clean.

h) The City will not be responsible for damages resulting from non-parking

activities undertaken by the University Lutheran Church to include but not be

limited to the following: 1) Placement of stored materials and equipment; 2)

Construction laydown areas; 3) Work areas.

i) The City agrees to hold harmless the University Lutheran Church and to

assume any and all liability resulting from the City’s use of the property

referred to herein.

j) Landlord agrees that his property will come under the jurisdiction of the

Clemson Police Department.
