Special Provisions for Payment of Post-High School Education
Post-High School Education
HUSBAND and WIFE shall each be responsible for the timely payment of fifty percent (50%) of the child's
expenses incurred and to be incurred for his post-high school education, including tuition, room, board, and books;
however, HUSBAND's responsibility and WIFE=s responsibility to timely pay such expenses is limited in amount, by
what the cost of such items and expenses would be if the child was attending the [name of school] as an in-state
student at the time when the child attains the post-high school education, with the assumption that the child does not
reside with either of the parties.
The term "post-high school education" as used herein, means attendance by the child as a full time student at
either a public or private college, university, or at a technical, vocational, or business school, and HUSBAND's
obligation and WIFE’s obligation shall be limited to a total of five years or the earning, by the child, of a bachelor's
degree, or of a technical vocational degree, or a business school diploma, whichever shall occur first. Further,
HUSBAND's obligation and WIFE’s obligation to pay expenses as set forth herein shall terminate if the child's
grades drop below an overall "C" average (or equivalent) for two or more semesters (or grading periods that are the
equivalent thereof), or the child's attainment of 25 years of age, whichever is first to occur.
Payment of Post-High School Education Expenses
Payments to be paid by HUSBAND and WIFE pursuant to their obligation to pay post-high school education
expenses of the children, as set forth herein, shall be paid to the institution of higher learning, provided HUSBAND
and WIFE are furnished with the name and address of the institution and the amount due to the institution for tuition,
room, board, activity fees, laboratory fees, books, and school related extra-curricular activities. Within seven (7)
days of the date HUSBAND is furnished with such information, HUSBAND shall pay such entity for fifty percent
(50%) of the expenses incurred and/or to be incurred either by paying such entity directly or by furnishing the child
with negotiable instruments payable to such entity enabling the child to timely pay such expenses. Within seven (7)
days of the date WIFE is furnished with such information, WIFE shall pay such entity for fifty percent (50%) of the
expenses incurred and/or to be incurred either by paying such entity directly or by furnishing the child with
negotiable instruments payable to such entity enabling the child to timely pay such expenses.
In the event WIFE pays an expense that is a post-high school education obligation of HUSBAND hereunder,
such payment or payments shall under no circumstances be construed to be a waiver of HUSBAND's obligation
hereunder, and such payment shall not preclude HUSBAND's obligations. In the event WIFE makes such a payment
or payments, then she shall become the person to whom HUSBAND's payment is due, provided HUSBAND is
furnished with her name and address and the amount that she has paid and the reason for the payment, i.e., why it is
to be paid by HUSBAND pursuant to this Agreement.
In the event HUSBAND pays an expense that is a post-high school education obligation of WIFE hereunder,
such payment or payments shall under no circumstances be construed to be a waiver of WIFE's obligation hereunder,
and such payment shall not preclude WIFE's obligations. In the event HUSBAND makes such a payment or
payments, then she shall become the person to whom WIFE's payment is due, provided WIFE is furnished with her
name and address and the amount that she has paid and the reason for the payment, i.e., why it is to be paid by WIFE
pursuant to this Agreement.
