Dependency Exemption
If there are two children and the parents are trading the exemptions:
IT IS FURTHER CONTRACTUALLY AGREED and THEREFORE ORDERED that MOTHER shall have the
exclusive right to claim the dependency exemption for CHILD1 for the calendar year _____ and all future years. IT
IS ORDERED that no later than ten days after the date of the Court’s signing this Order, FATHER shall execute and
deliver to MOTHER a Release of Claim to Exemption for Child of Divorced or Separated Parents (IRS Form 8332)
in which he waives any claim of the dependency exemption for CHILD1 for the calendar year _____ and all future
years and gives MOTHER that exclusive right.
IT IS FURTHER CONTRACTUALLY AGREED and THEREFORE ORDERED that FATHER shall have the
exclusive right to claim the dependency exemption for CHILD2 for the calendar year _____ and all future years. IT
IS ORDERED that no later than ten days after the date of the Court’s signing this Order, MOTHER shall execute and
deliver to FATHER a Release of Claim to Exemption for Child of Divorced or Separated Parents (IRS Form 8332) in
which he waives any claim of the dependency exemption for CHILD2 for the calendar year _____ and all future
years and gives FATHER that exclusive right.
If Mother is giving a dependency exemption to father:
IT IS FURTHER CONTRACTUALLY AGREED and THEREFORE ORDERED that FATHER shall have the
exclusive right to claim the dependency exemption for CHILD for the calendar year _____ and all future years. IT IS
ORDERED that no later than ten days after the date of the Court’s signing this Order, MOTHER shall execute and
deliver to FATHER a Release of Claim to Exemption for Child of Divorced or Separated Parents (IRS Form 8332) in
which he waives any claim of the dependency exemption for CHILD for the calendar year _____ and all future years
and gives FATHER that exclusive right.
