OCCUPANCY PERMIT GUIDE
Please, be notified that pursuant to the Winnipeg Building By-law No. 4555/87, it is your
responsibility and duty to obtain a Building Occupancy Permit before occupying the premises or
allowing others to occupy it.
To assist you in obtaining the Building Occupancy Permit, which has already been paid for,
enclosed is a "Request for a Building Occupancy Permit" form. This form must be completed and
returned to the occupancy office. Occupancy permit requests, which trigger occupancy
inspections, should be made upon completion of all the required work and the submission of all
required professional certification letters, test reports and shop drawings.
Should occupancy be needed for partial use of the premises (floor, wing, or defined area), a partial
Interim Occupancy Permit may be requested. A clear written or graphic delineation of the
applicable project phases, along with corresponding floor areas must be submitted along with the
request. Such proposals will be entertained at the City’s discretion.
Note: Additional fees will be due pursuant to The Planning, Development and Building Fees By-law
No. 66/2016 prior to the issuance of a Final Occupancy Permit, an Interim Occupancy Permit and
each subsequent extension the City may approve, should a request for occupancy result in a denial
or interim approval. A monthly non-compliance fee will also be applied, should occupancy occur at
any time without a valid occupancy permit. All fees owing in association with a permit have to be
paid in full prior to an Interim or Final Occupancy Permit being granted.
Occupancy Prior to the Issuance of an Occupancy Permit
Generally, the installation of equipment and affixed furniture such as cupboards and shelving is
considered a part of the construction process. However, moving of loose furniture, stock or
goods, inventory, accessory equipment, or personal belongings into the premises is considered
occupancy.
Any occupancy without a valid Building Occupancy Permit is a violation of The Winnipeg Building
By-law and subject to enforcement action. This is typically taken jointly against the property
owner and the occupant. When it is evident that other involved persons including the applicant,
directors and officers have personal knowledge of the offence, enforcement action including
charges may extend to them as well. We trust we shall receive your co-operation in this matter.
