ANY DEPOSIT HELD ON BEHALF OF THE TENANTS WILL BE SUBMITTED TO MY
DEPOSIT SCOTLAND WHO ARE THE GOVERNING BODY APPROVED.
TERMINATION
This agreement may be terminated by either party by way of three months’
written notice. A fee of £500 plus VAT will be payable where the Landlord intends
to continue letting to tenants introduced by the Agent after the termination of this
agreement.
The Landlord shall provide the Agent with any requirements for return and
possession of the property at the earliest opportunity. Landlords should be aware
that any tenancy agreement entered into on the Landlord’s behalf is a binding
legal agreement for the term agreed. Details of any tenancy agreement being
entered into will be communicated to the Landlord as soon as possible. Landlords
should be aware that the legal minimum notice period to tenants under a Short
Assured Tenancy is generally two months ( should the contact allow for early
termination) and this needs to be given even in the case of a fixed term tenancy
which is due to expire.
SOLE LETTING
It is agreed that only the Agent may let the Property. The Landlord will be liable to
pay remuneration to the Agent, in addition to any other costs or charges agreed, in
each of the following circumstances:-
If a tenant enters into an unconditional agreement to lease, buy or exchange
the Property within the initial period of two months during which the Agent has a
sole lettings rights agency, even if the tenant or purchaser was not found by the
Agent buy by another agent or by any person, including the Landlord.
If after the expiry of two months, an unconditional agreement to lease, buy
or exchange the Property was concluded to a person who was introduced to the
Landlord during that period or with whom the Agent had negotiations about the
Property during that period.
Remuneration payable in this situation is £500.00 (see ‘Termination’ paragraph
above)
