Center Project Job Creation Report
This form and supplement pages (Form 01-161) are used to provide detailed information about each qualifying job created for certification
of a qualifying data center or qualifying large data center project. The qualifying owner, operator or occupant of a qualifying data center or
qualifying large data center project must, either singly or jointly, commit to creating at least 20 qualifying jobs for a qualifying data center or 40
qualifying jobs for a qualifying large data center project in the county in which the data center is located, not including jobs moved from one
Texas county to another, within five years from the date the data center is certified by the Comptroller as a qualifying data center. See Texas
Tax Code Sections 151.359 and 151.3595.
General Information
Who Must File This Report? The qualifying owner, operator and/or occupant of a qualifying data center or qualifying large data center project must
jointly file the report and provide all requested information about each qualifying job created. Please submit only one report per data center.
What is a Qualifying Job? A qualifying job is a new full-time, permanent job created by a qualifying owner, qualifying operator or qualifying occupant,
either singly or jointly, that is located in the same Texas county as the associated qualifying data center or qualifying large data center project, pays at
least 120 percent of the county average weekly wage in the county in which the job is located and that will last at least five years from the date of its
creation. To be considered full-time, the position must provide at least 1,820 hours of employment a year to a single employee.
The term includes a new employment position staffed by a third-party employee or contractor that meets the requirements stated above, if there is a written
contract between the contractor or third-party employer and a qualifying owner, qualifying operator or qualifying occupant of the associated qualifying data
center or qualifying large data center project, which does the following:
provides for shared employment responsibilities between the contractor or third-party employer and the qualifying owner, qualifying operator
or qualifying occupant; and
provides that the third-party employee is permanently assigned to the associated qualifying data center, qualifying large data center project,
or another location operated by the qualifying owner, qualifying operator or qualifying occupant within the county where the data center is
located for the term of the written contract.
When is the Report Due? The report is due as soon as either at least 20 qualifying jobs for qualifying data centers or 40 qualifying jobs for qualifying
large data center projects have been created, or by the fifth anniversary of the date the qualifying data center or qualifying large data center project
was certified by the Comptroller, whichever comes first.
