PROOFS OF IDENTITY
Use this form and complete form MV-44 “Application for Permit, Driver License, Non-Driver ID” when you apply for a
Learner Permit, Driver License, or Non-Driver ID Card.
GENERAL REQUIREMENTS TO PROVE YOUR IDENTITY

You must provide
documents or documents that are certified by the issuing agency. However, if DMV allows you to send your
ORIGINAL
application by mail, you must send photocopies, do not send the original documents.
The New York State Department of Motor Vehicles (DMV) will not issue a learner permit, driver license or non-driver ID card for the first

time, or if you have a document that has been expired for more than 2 years, until you do the following:
1.
Prove your date of birth - Present one of the documents from the list below.
2.
Prove your name - You must show your Social Security card and one or more documents that total 4 points from the list below. If
you are not eligible to have a Social Security card, you must show documents that total 6 points from the list below and a letter from
the Social Security Administration (SSA) that was issued within 30 days of your application to DMV; the letter must state that you are
not eligible to have the card. You must also show the Department of Homeland Security documentation that was used by the SSA to
determine that you are not eligible.
Your name must be the same on each document that you show to prove your name.
IMPORTANT:
If you have a valid NYS DMV photo document or a NYS DMV photo document that can be renewed, you can use that document
NOTE:
to meet the required 6 points for proof of name and proof of date of birth (if required). If DMV has no record of your Social Security
number, you must also meet the Social Security requirements that are explained above.

Your signature must be on at least one of the documents that you show for proof.
DMV will not accept more than one document of the same type of proof. For example, 3 major credit cards count as one credit card. DMV
u
will accept one INS/DHS document, which will be used to prove name and date of birth.

DMV will not accept documents with any alterations or erasures. DMV will confiscate all documents that appear to be fraudulent so the
documents can be reviewed by DMV's Investigations Unit. If you submit a fraudulent document, you may be subject to criminal prosecution.
If you want an Enhanced Driver License you must also prove you are a U.S. citizen and a resident of NYS. Refer to form

If you want a Commercial Learner Permit or Commercial Driver License you must prove that you are a NYS resident and you must also
prove that you are a U.S. citizen, a lawful permanent resident, or that you have temporary legal presence in the U.S. Refer to form
ID-44CDL for a list of documents that you can show for proof.
Making a false statement in an application or in any proof or statement in conjunction with it, or deceiving or substituting, or
IMPORTANT:
causing another person to deceive or substitute in connection with such application, is punishable as a Class A misdemeanor pursuant to
Section 210.45 of the Penal Law for Non-Driver card applicants, and is a misdemeanor under Section 392 of the Vehicle and Traffic Law
for driver license applicants, and may result in the revocation or suspension of your license.
