Specific Instructions For Explanation Of Request

For Appeal

In the space provided or on additional schedules that you

provide, fully explain each of the following:

A. UNAGREED ACTIONS TAKEN

If the Notice you received was for the 3% pull-tab tax,

1% additional fee, permit, or license fee plus interest

and penalty, denial, suspension, revocation, or informal

conference decision, list those items to which you take

exception appearing in the Notice or Informal Conference

Decision and provide the explanations and legal authorities

required by (B) and (C).

B. FACTS

If the facts that you rely on are different from those the

division personnel or hearing officer relied on, provide a

statement of the facts in writing and certified to be true

under penalty of perjury. All evidence submitted, except

that of a supplementary or incidental character, must be

declared to be true under penalty of perjury.

C. LAW

Explain which sections of the Alaska Statutes, regulations,

other laws, and court cases which, in light of the evidence,

support your position.

D. AGREED FINDINGS

You must pay the amounts assessed on or before the

dates indicated in the Notice of Assessment. Please note

that AS 05.15.095(b) provides:

“(b) A permittee or operator may not conduct an activity

under this chapter during a period in which a report or fee

is delinquent.”
