Since you were married during both years and you maintain the same principal
residence, your status for both years is “Married.” You will be entitled to a
reimbursement as long as you satisfy all the other eligibility requirements.

Q.
My wife rents an apartment in Teaneck, while I own and live in a home in
Jersey City. We file separate income tax returns. Am I entitled to only one-half
of the property tax reimbursement?
A.
No. Because you and your spouse maintained separate residences and you did
not have access to or receive support from your spouse’s income, you are
considered to be “Single” for the purposes of the property tax reimbursement and
you are entitled to the full reimbursement as long as you satisfied all the other
eligibility requirements.
MULTIPLE OWNERS
If you are eligible to receive the property tax reimbursement and you owned your residence with
someone else other than your spouse, you are only entitled to receive a proportionate share of
the reimbursement that you would have received if you owned the property by yourself.

Q.
My two sisters and I live in a home that we own together. One of my sisters is
eligible to receive the property tax reimbursement but one of them is not. Will
I still receive a reimbursement?
A.
When a residence is owned by more than one individual (other than husband and
wife) each eligible owner is entitled to his or her proportionate share of the property
tax reimbursement based on his or her share of the property. Since you own one-
third of the property, you and your eligible sister are each entitled to one-third of the
reimbursement. Share of ownership of the property is considered to be held equally
by all owners. If the shares of ownership are not equal, you must provide
documentation as to the percentage of ownership. When you complete Form
PTR-1, report only your share of the property taxes for both the base year and the
reimbursement year.

Q.
My brother and I own a home together in Elizabeth. Although my brother pays
all of the property taxes he does not live there with me. Are we each entitled
to one-half of the property tax reimbursement?
A.
No. Since your brother does not live in this home he is not eligible for the
reimbursement. On the other hand, you are entitled to the reimbursement if you
met the other eligibility requirements because the property taxes were paid.
However, you are only entitled to receive one-half of the reimbursement since you
only own one-half of the property. When you complete Form PTR-1, report only
your share of the property taxes for both the base year and the reimbursement
year.
