B. Participation Requirements
Participants in the Tax Amnesty program owe certain state and local taxes, penalty, or interest for an original return due date prior to
July 1, 2003 and have not filed a return, or filed an incorrect return, or filed a correct return but did not pay the tax.
All participants must sign, date, and submit a North Dakota Tax Amnesty Application.
Participants conducting business in North Dakota that are not registered in the state must complete and attach the appropriate business
registration form (for example: a sales tax permit, withholding tax account).
All participants must attach all previously unfiled or amended returns to the Tax Amnesty Application. If applicable, attach copies of
the most recent accounts receivable billing, Notice of Determination, Notice of Reconsideration, and Proposed Assessment.
All applications, required documentation, and payment must be postmarked by the U.S. Postal Service between Wednesday, October 1,
2003 and Saturday, January 31, 2004.
A minimum payment of 50 percent of the total tax is due with the Tax Amnesty Application, unless paying by credit card (see Part C
below). The remaining balance of tax and interest must be paid in full between October 1, 2003 and January 31, 2004. (Be sure to
keep copies of the Tax Amnesty Application and cancelled checks for your records.)
Participants agree to withdraw any pending protest or proceedings about the tax and interest reported under Tax Amnesty and
understand that any protest or proceedings cannot be refiled.
C. Payment
To receive a complete waiver of penalty and a waiver of 75 percent of the statutory interest, you must pay in full within the Tax Amnesty
period. Failure to pay in full within the Tax Amnesty period will result in a revocation of Amnesty and reinstatement of full penalty and
interest. Payment may be made by check, money order, cashier's check, cash, or credit card. Cash payments are only accepted if made in
person at the Tax Department. Payment may be made by credit card only over the Internet through our service provider. Please indicate
