Preservation (referred to in this subsection as

the ‘Council’) to establish procedures to satisfy

the requirements described in subparagraph (A)

(including regulations).

.—If, in an analysis re-

quired under the National Environmental Pol-

icy Act of 1969 (42 U.S.C. 4231 et seq.), the

Secretary determines that there is no feasible or
14
prudent alternative to avoid use of a historic
15
site, the Secretary may—
16
‘‘(i) include the determination of the
17
Secretary in the analysis required under
18
that Act;
19
‘‘(ii) provide a notice of the deter-
20
mination to—
21
‘‘(I) each applicable State his-
22
toric preservation officer and tribal
23
historic preservation officer;
24
‘‘(II) the Council, if the Council
25
is participating in the consultation
