local transportation employees under this subsection

shall be provided—

‘‘(A) by the Secretary at no cost to the

States and local governments for subjects that
5
are a Government program responsibility; or

‘‘(B) when the education and training are
7
paid under paragraph (4), by the State, with
8
the approval of the Secretary, through grants
9
and contracts with public and private agencies,
10
other institutions, individuals, and the institute.

a State or public transportation authority in the

of the Secretary, to pay not more than 80 percent
19
of the cost of tuition and direct educational expenses
20
related to educating and training State and local
21
transportation employees under this subsection.’’.

.—Section 5322 of such title, and the
EPEAL
23
item relating to that section in the analysis for chapter
24
53 of such title, are repealed.
