local transportation employees under this subsection

shall be provided—

‘‘(A) by the Secretary at no cost to the
4
States and local governments for subjects that
5
are a Government program responsibility; or
6
‘‘(B) when the education and training are
7
paid under paragraph (4), by the State, with
8
the approval of the Secretary, through grants
9
and contracts with public and private agencies,
10
other institutions, individuals, and the institute.

a fiscal year beginning after September 30, 1991, to

a State or public transportation authority in the

State to carry out sections 5307 and 5309 is avail-

able for expenditure by the State and public trans-

portation authorities in the State, with the approval
18
of the Secretary, to pay not more than 80 percent
19
of the cost of tuition and direct educational expenses
20
related to educating and training State and local
21
transportation employees under this subsection.’’.

.—Section 5322 of such title, and the
EPEAL

item relating to that section in the analysis for chapter

53 of such title, are repealed.
