entity who completed a verification under subsection

(b), motor carrier data (other than the information

described in paragraph (1)) created or maintained

by the Federal Motor Carrier Safety Administration,

including SMS data or analysis of such data, may
9
not be admitted into evidence in a case or pro-
10
ceeding in which it is asserted or alleged that the en-
11
tity’s selection or retention of a motor carrier was
12
negligent.

.—This section shall cease to be effective

on the date on which the Inspector General of the Depart-

ment makes the certification under section 5223(a).
