‘‘(3) P
.—The Secretary shall establish a

process to allow a State to cease to collect the subset

referred to in paragraph (2)(A) for public roads that
4
are gravel roads or otherwise unpaved if—
5
‘‘(A) the State does not use funds provided
6
to carry out this section for a project on such
7
roads until the State completes a collection of
8
the required model inventory of roadway ele-
9
ments for the roads; and
10
‘‘(B) the State demonstrates that the State
11
consulted with affected Indian tribes before
12
ceasing to collect data with respect to such
13
roads that are included in the National Tribal
14
Transportation Facility Inventory.

‘‘(4) R
.—Nothing in
