Class I railroads, Class II railroads, and Class III rail-

.—The Secretary shall—

‘‘(1) maintain on file a copy of the most recent

comprehensive oil spill response plans prepared by a
9
railroad carrier transporting a Class 3 flammable
10
liquid; and

‘‘(2) provide to a person, upon written request,

a copy of the plan, which may exclude, as the Sec-
13
retary determines appropriate—
14
‘‘(A) proprietary information;
15
‘‘(B) security-sensitive information, includ-
16
ing information described in section 1520.5(a)
17
of title 49, Code of Federal Regulations;
18
‘‘(C) specific response resources and tac-
19
tical resource deployment plans; and
20
‘‘(D) the specific amount and location of
21
worst-case discharges, including the process by
22
which a railroad carrier determines the worst-
23
case discharge.
