under the ownership of the local jurisdiction (other than

a highway on the Interstate System) if—

(1) the local jurisdiction is a direct recipient of

Federal funds for the project;
5
(2) the roadway design publication—
6
(A) is recognized by the Federal Highway
7
Administration; and
8
(B) is adopted by the local jurisdiction;
9
and
10
(3) the design complies with all other applicable
11
Federal laws.

(B) refers to this section.
