Air Act (42 U.S.C. 7401 et seq.), the State may use

funds apportioned to the State under section

104(b)(4) for any project in the State that—

‘‘(A) would otherwise be eligible under sub-
6
section (b) if the project were carried out in a
7
nonattainment or maintenance area; or

‘‘(B) is eligible under the surface transpor-
9
tation block grant program under section 133.

amount of funds that the State would have re-

ceived based on the nonattainment and mainte-

nance area population of the State under sub-
19
paragraphs (B) and (C) of section 104(b)(2), as
20
in effect on the day before the date of enact-
21
ment of the MAP–21, the State may use, for
22
any project that would otherwise be eligible
23
under subsection (b) if the project were carried
24
out in a nonattainment or maintenance area or
25
is eligible under the surface transportation
