each fiscal year, or as soon as practicable thereafter,

and after making a deduction under section

31104(c), the Secretary shall allocate amounts made
14
available under section 31104(a)(1) to carry out this
15
section for the fiscal year among the States with
16
plans approved under this section in accordance with
17
the criteria prescribed under paragraph (1).

availability of funding and notwithstanding fluctua-
20
tions in the data elements used by the Secretary to
21
calculate the annual allocation amounts, after the
22
creation of a new allocation formula under section
23
5106 of the Surface Transportation Reauthorization
24
and Reform Act of 2015 the Secretary may not
25
make elective adjustments to the allocation formula
